Modern slavery includes forced labor, the worst forms of child labor, deceptive recruiting, debt bondage, trafficking in persons, slavery and servitude.
Human trafficking is a serious violation of human rights and is considered a form of modern slavery. Human trafficking is the illegal trade of people for exploitation purposes, often involving forced labor, sexual exploitation, or other forms of coercion. It can occur within a country or across international borders.
US law prohibits human trafficking. US law also prohibits the importation of goods made with forced labor in the Xinjiang Uyghur region of China. EU regulations also provide guidance to ensure that imported goods are not produced using forced or child labor.

What disclosure laws apply?

The U.K. Modern Slavery Act was adopted in 2015, and Australia adopted a Modern Slavery Act in 2018. Legislation has been proposed in the USA and Canada, and states are considering laws requiring modern slavery disclosures. The proposed EU Directive on Corporate Sustainability Due Diligence aims to require companies to conduct due diligence to identify, prevent, and mitigate human rights and environmental impacts in their supply chains, including the prohibition of forced labor.

The Australian Act requires corporations with annual revenue of AUD $100 million to prepare and publish an annual modern slavery statement. The statement must include the following disclosures:

  1. Organizational Structure: Information about the entity, including its structure, operations, and supply chains.
  2. Risk Assessment: Details about the potential risks of modern slavery practices in the entity’s operations and supply chains.
  3. Actions Taken: Description of the actions the entity has taken to assess and address those risks, including any due diligence processes.
  4. Effectiveness of Actions: An evaluation of the effectiveness of those actions in combating modern slavery.
  5. Consultation: Information on any consultation that occurred with any subsidiaries of the entity in preparing the statement.
  6. Future Plans: A discussion of any planned steps to address modern slavery risks in the future.
